Indiana law is very clear. In order for a police officer to stop a person for a traffic violation the officer must be in fully marked police vehicle or wearing a full police uniform. Indiana law doesn’t require both, but one or the other. The cases that have litigated this issue typically deal with undercover cars pulling over individuals for traffic violations. When these undercover officers exit their unmarked undercover vehicle these officers typically only have their badge on display or a vest or sweater marked with “Police.” This is clearly not enough and does not meet the requirements under Indiana Law.
If you or a loved one are driving and you see flashing lights behind you indicating that you are being pulled over, make note if the car is fully marked. Are the police lights on the top of the vehicle? Does the vehicle have the words “Police”, “Trooper” or “Sheriff” prominently displayed on the vehicle? If the vehicle is not a fully marked police vehicle, is the officer in a full uniform?

If you are being pulled over, slow down and pull into the safest well-lit area possible. Keep your doors locked until you are sure the person pulling you over is a legitimate Police Officer.
