Driving with a Controlled Substance in Indiana: What You Need to Know

If you have a controlled substance in your system—such as marijuana, cocaine, or prescription medication—getting pulled over by police can be very bad news. The law in Indiana says that driving with drugs or a controlled substance in your body is treated the same as a DUI / OVWI

A DUI Without Alcohol? 

If a police officer suspects you might be under the influence of something other than alcohol, they can get a warrant for a blood draw. If the test shows you have a controlled substance in your system, that means you can be charged with a DUI. 

You’ll be facing a Class A misdemeanor, which carries a maximum penalty of 365 days in jail and a $5,000 fine. This is true even if you ingested the substance long before driving and you weren’t intoxicated while you were behind the wheel. It’s not fair, but that’s the law in Indiana.
